The first thing you have to figure
out is what are my damages. Almost everyone wants money and a whole lot of it. Most people don't receive the amount they had
hoped for. You should be prepared to recoup only what you lost plus your court cost. An attorney will usually get anywhere
from 30% to 40% of the amount you receive. There are cases where an attorney is required. For instance if you are seeking
punitive damages. This is a very complicated case and needs experts, serious injury and a jury.

HOW MUCH WILL THIS COST?
From county to
county the filing fee may change. You would need to get a hold of your county clerk and ask. Every county usually has a website
where phone numbers are available along with other information. Some may provide the filing fee, I have even come across some
websites that have the forms you will need. You just have to know where to look.
HOW LONG WILL THIS TAKE
This is a question that usually leaves people
annoyed and they will either give up or become very aggravated. This is what the attorneys from the other side want.
They will try to overwhelm you with paper work so you will give up. For instance Social Security Disability can take anywhere
from 6 months to 2 yrs. The good news is when your case is finally approved, you usually receive back payments from the time
you filed. So if it takes two years you will receive a substancial check. The bad news is your sick and can't work so you
have to figure out a way to survive all that time. I can give you some tips.
WHAT KIND OF EXHIBITS WILL I NEED?
One of the first things to do is to take
pictures. This includes damage to yourself, car, home or personal property. Try to communicate through e-mail and make sure
to save those e-mails. Use a thumb drive if possible. Keep any documents you receive. Keep the envelopes. If you send something
back in the mail, go to the post office and have it sent certified, make copies for your file. Keep the certifiction.
Always start a file and keep everything together. Write all phone numbers and confirmation numbers on the file and make sure
to date each one. Keep all receipts, if you go to a doctor and you are not a receipt ask for one. Keep all doctors reports
such as MRI's together date and put which doctor you got this. Make sure to ask your doctor for a written report of your injuries.
Try to keep a daily or weekly journel on the progress or the worsening of you condition. If the doctor claims you have no
injuries, get a second opinion from another doctor not affilated with the insurance company or Social Security.
